Trukbite Terms of Service
Effective date: [date]
These terms are an agreement between you and [Trukbite legal business name] ("Trukbite", "we", "us") about using the Trukbite app. By using Trukbite, you agree to them. If you don't agree, please don't use the app. Our Privacy Policy explains how we handle your information.
Who can use Trukbite
- You must be at least 13 years old. If you're under 18, a parent or guardian should review these terms with you.
- To run a truck on Trukbite, you must be at least 18 and authorized to act for the truck's business.
- One person per account. Keep your phone secure: anyone who can receive your sign-in codes can use your account.
What Trukbite is (and isn't)
Trukbite shows where food trucks are and will be, based on what truck owners post. We don't own, operate or inspect any truck, and we don't prepare, sell or deliver food.
- Locations, hours, menus, prices and sold-out status come from truck owners and can be wrong or out of date. A truck may close early, move, or not show up. Check before you make a special trip.
- Food safety, allergens and the food itself are the truck's responsibility. Dish tags like "Vegan" or "Gluten-free" are set by the truck. If you have an allergy, ask the truck directly.
- Ratings and reviews are opinions of other customers, not Trukbite's.
Your content
"Content" means anything you post: reviews, photos, ratings, names, and for owners, truck profiles, logos, menus and schedules.
- You keep ownership of your content.
- You give Trukbite a non-exclusive, worldwide, royalty-free license to host, display, copy, resize and share your content in the app and in promoting Trukbite (for example, showing a truck's logo in an ad for the app). This license ends when you delete the content or your account, except for copies already shared or kept as required by law.
- You're responsible for your content and promise you have the right to post it.
Rules for reviews and photos
Reviews help everyone, so keep them honest and about your own experience. Don't post:
- anything off-topic or about something other than the truck and its food;
- hateful, harassing, threatening or sexually explicit content;
- fake reviews, including reviews of your own truck or a competitor's, or reviews you were paid or rewarded for;
- other people's personal information (phone numbers, addresses, license plates, faces of people who didn't agree);
- anything illegal or that infringes someone else's rights.
Anyone can report a review. We may remove content or accounts that break these rules, and we decide in our judgment. Truck owners can reply to reviews once, publicly, but can't edit or remove them.
Truck owners
If you list a truck, you also agree that:
- You hold the permits and licenses your truck needs, including a current San Antonio Metro Health mobile food vendor permit, and that the permit photo you upload is genuine. We verify permits by hand and may reject or remove a truck at our discretion. If your permit expires, your truck is hidden until you upload a renewed one.
- What you post is accurate. Only tap Open here when you're actually open at that spot, keep your hours and menu up to date, and close your truck when you leave. Trukbite may close trucks automatically at their posted closing time.
- You follow the law where you park, including property owners' permission, city rules and health codes. Trukbite doesn't arrange parking or permission for any location.
- Your team: you're responsible for the staff you invite and what they do in the app. You can remove them at any time.
- Stats show totals about your truck. Don't try to identify individual customers.
[Lawyer: consider adding an indemnity from truck owners for claims arising from their food, operations and permits.]
Pro plan and payments
- Trukbite Basic is free. Trukbite Pro is a paid subscription for truck owners: [$14.99 per month or $149 per year], plus taxes where they apply. Pro includes staff accounts, stats and insights, and other features we describe in the app.
- Founding trucks receive [6 months of Pro free, then 50% off for as long as the subscription stays active].
- Subscriptions renew automatically until you cancel. You can cancel at any time, and Pro stays active until the end of the period you've paid for. We don't give refunds for partial periods unless the law requires it.
- We'll tell you at least [30 days] before any price change takes effect for your subscription.
- If a payment fails or Pro ends, Pro features stop, including staff access; your truck stays listed on Basic.
[Lawyer: confirm auto-renewal disclosures required under Texas and app store rules; payments are not live yet.]
Things you can't do
- Break the law or help anyone else do so.
- Pretend to be someone else, or list a truck you don't own or run.
- Scrape, copy or resell Trukbite data, or use bots or automated tools on the app.
- Interfere with the app, try to get around its limits or security, or access accounts or data that aren't yours.
- Use Trukbite to spam people or send unwanted messages.
Ending your use
You can stop using Trukbite and delete your account at any time (Profile → Delete account). We may suspend or close accounts, or remove trucks or content, that break these terms or put people at risk. Sections that by their nature should continue (like content licenses already used, disclaimers and limits of liability) survive after your account ends.
Disclaimers
Trukbite is provided "as is" and "as available". To the fullest extent the law allows, we make no promises that the app will always be available, error-free or accurate, or that any truck will be where the app says. Your use of trucks and their food is at your own risk.
Limits on our liability
To the fullest extent the law allows, Trukbite isn't liable for indirect, incidental, special, consequential or punitive damages, or for lost profits or data, arising from your use of the app or any truck. Our total liability for any claim about Trukbite is limited to the greater of [$100] or the amount you paid us in the 12 months before the claim. Some places don't allow these limits, so they may not all apply to you.
Disputes
These terms are governed by the laws of the State of Texas, without regard to its conflict-of-law rules. Any dispute will be brought in the state or federal courts located in Bexar County, Texas, and you and Trukbite agree to those courts' jurisdiction.
[Lawyer: decide whether to add an informal-resolution step, arbitration and class-action waiver, or a small-claims carve-out.]
Changes to these terms
We may update these terms. If a change is important, we'll tell you in the app before it takes effect. If you keep using Trukbite after that, you accept the new terms.
Apple and Google
If you downloaded Trukbite from the App Store or Google Play, these terms are between you and Trukbite, not Apple or Google, and their store terms also apply. [Lawyer: add Apple's required end-user terms before the iOS release.]
